Limited Health Guarantee and Contract Terms

​

**Please understand that we have made every effort to ensure that your kitten is healthy. But in the unlikely event that your kitten should have serious health problems we could not detect, the following agreement is necessary.**

​

• This cat/kitten is to be of sound health upon arrival. Breeder/seller guarantees the health of the above mentioned kitten for 72 hours, from the date of pickup or delivery. Kitten must be vet checked by their own vet within the 72 hour time frame. Failure to do so will result in this health agreement to be null and void. It is recommended that the new cat be kept in quarantine during this time. If your vet finds a life threatening disease or congenital defect, buyer must notify the breeder immediately with letter/fax from the examining veterinarian. If you wish to return the kitten, you will need to return:  the registration papers, vaccination history, x-rays, and a written statement from your vet stating the diagnosis. Claims must be made within the 72 hour period as stated previously, and are subject to our veterinarian’s inspection. Breeder is not responsible for any costs incurred once the buyer has taken possession of the kitten. Buyer is responsible for all costs of returning the kitten to the breeder and all costs for delivery of a new kitten (if applicable). The buyer is responsible to notify the breeder immediately of any adverse findings.

• If said kitten/cat should die due to a congenital defect during the first year (one year from birth date) of life, the kitten/cat will be replaced only if necropsy has been preformed and a certificate from your vet is provided as proof of the cause of death. The kitten/cat will be replaced with a kitten of comparable quality and value, upon availability. This same replacement solution will be implemented in the eventuality that the “new kitten check-up”, during the buyer’s first 72 hours of possession, reveals an untreatable, life threatening defect/illness. Providing the breeder with written veterinary proof is necessary for validity in either of the above incidences. Buyer is responsible for shipping. If the breeder cannot replace said kitten with a new kitten within one year, breeder will refund buyer the price of the kitten only.

• The breeder/seller will have completed all of the appropriate vaccinations and worming prior to the kitten/cat leaving. All kittens will be vaccinated only for: Rhinotracheitis, Calicivirus, Panleukopenia.

• The FELV vaccination can be given at buyer's discretion

• The breeder/seller does not warranty the kitten/cat against any adverse reactions to future vaccinations

• Failure to keep the said kitten/cat up to date on vaccines will render this contract as null and void

• The administration of the FIP (Feline Infectious Peritonitis) vaccine is not advised! If the kitten/cat is vaccinated against FIP the contract is null and void

• Declawing is an extremely stressful and painful procedure that is not advocated by the breeder/seller. Having your Sphynx declawed will render this contract null and void

• Buyer accepts all responsibility for protecting kitten/cat from said diseases, illnesses, parasites and fungi.

• Buyer accepts full responsibility of caring for the kitten/cat. Buyer will provide the kitten/cat with proper health care, nutrition, and a pleasant environment to reside in. The cat/kitten is to be given water and plenty of dry food freely (Sphynx have a higher metabolism than a normal cat. They do need to eat more to keep their body temperature up.) Buyer agrees to provide immediate veterinary care to the kitten/cat if it shows any signs of illness or injury. Seller is not responsible, under any circumstance, for any veterinary bills incurred by the buyer.

• Buyer agrees that if, for any reason, they cannot keep the kitten/cat they will contact the seller/Breeder, Jaclyn Rivera.

• Under no circumstance is the kitten/cat to be given or transferred to anyone (without Breeders written consent) or to the pound, animal shelter, or sold/given to any pet store or animal research facility.

• This kitten/cat will not be allowed to roam outdoors freely like other cat breeds. Due to lack of hair Sphynx can freeze or sunburn easily.

• Buyer is aware that the degree of hairlessness varies from cat to cat, and that no Sphynx is completely hairless. Sphynx can grow hair at any stage in their life. Hormones, climate, and genetics play a role in the hairlessness of the Sphynx. Even though a kitten may be almost hairless when it is sold, it is possible for it to develop some hair as it gets older.

• It is very important to keep your kitten warm. If you are cold, they are probably cold. There are electric pet beds sold at most pet supply retailers. They just love them and are safe for your pet. Sphynx like to be covered by blankets. Leaving a blanket around for them to hide in is a good idea.

• If this kitten is found to be neglected, or in ill health due to neglect, the buyer will surrender the kitten back to the breeder unconditionally.

• All pet kittens not for breeding should be spayed or neutered at 5lbs or 6 months of age whichever comes first, at buyer’s expense. Registration papers WILL NOT be released until proof from your vet is provided that the cat/kitten has been sterilized. If kitten is not spayed/neutered, seller WILL enforce breach of contract for the maximum dollar amount ($2000 which is the amount that kittens are sold with full rights).

• If this kitten is purchased as a breeder/stud, purchaser agrees not to resell this cat/kitten for use as a breeder/stud to anyone UNLESS approved by seller. Seller makes no guarantees as to fertility or performance of cats or kittens when purchased for breeding/showing.

• Buyer is responsible for all shipping cost. Shipping prices can vary. Price depends on the airline and location the kitten is flying to. Shipping can be anywhere between $250 and $400.

• All cost for shipping and total sale price must be paid in full (payment method must clear in the bank) before any shipping will be scheduled or paid for.

• ­­­­­Seller is NOT RESPONSIBLE for kitten/cat once it is accepted by the airline carrier or transporter. The seller is not responsible for any kitten/cat that gets lost or stolen after acceptance by the airline carrier or transporter. It is the responsibility of the buyer to file a claim with the airline carrier or transporter in the event of loss, stolen, damaged, delayed, injury or death of the kitten/cat.

• Seller reserves the right to cancel this contract and return deposit to purchaser.

Buyer and Breeder/Seller have read and fully understand the terms of this contract and do agree to all terms. There are neither: other conditions, nor guarantees, verbal or implied. No verbal deviations or additions are valid. No other warranties or guarantees are provided other than those specifically outlined above. Changes or additions to this Contract must be initialed by all parties. Signatures and date below on this document indicate full agreement to ALL terms set forth in this contract. Buyer acknowledges that he/she has read, understands and agrees to ALL of the terms and conditions stated above.
